Privacy Policy

Your privacy is critically important to us. We at Dwyco, Inc. (“Dwyco”) have a few fundamental principles:

  • First and foremost, Dwyco makes an effort to avoid collecting or storing personal information from your devices. However, companies like Google and Apple require us to collect some information in order to provide some form of "content moderation" for user-generated content. We're not making this up. You can read the developer agreements we have to comply with, if you are interested. That said, Dwyco is not in the business of collecting and selling personal information, so the information we use is minimal.

  • We don't use your personal information without your consent.

  • We don’t ask you for personal information unless we truly need it.

  • We don’t share your personal information with anyone except to comply with the law, develop our products and services, or protect our rights.

  • We treat your personal information with the highest regard to privacy and security.

Dwyco respects your right to privacy and shares your concern about the security of any data you may submit to Dwyco via Dwyco’s services (the “Site”), currently accessible at http://www.dwyco.com, our installable desktop apps (CDC-X) and mobile apps (currently alpha-test-only for Android "Phoo", and "Dwyco Rando"). The following statement (the “Privacy Policy”) discloses the guidelines Dwyco has established for protecting the information you provide to Dwyco during your visit to the Site.

What does Dwyco do to protect the data I transmit to Dwyco?

Personal information communicated via Dwyco apps (whether peer-to-peer, or via Dwyco servers) is sent using modern cryptography (via HTTPS and other industry standard methods described in NIST Spec. Pub. 800-56A, Rev2 with AES/GCM). All private user-to-user communications are end-to-end encrypted (Dwyco cannot read your communications.) All communications sent to public-chat areas (which are clearly marked) are encrypted, but are considered "public" (ie., anyone accessing the public chat room will see the messages you send to the chat room.)

What information about me does Dwyco collect and how is it used?

Dwyco only collects personal information about you if you voluntarily choose to share it with Dwyco. Dwyco does not share, rent or sell information concerning Dwyco’s members or other users of its website to third parties in ways other than disclosed in this privacy statement.

Dwyco does not knowingly collect personal information from people under 18 years old.

Dwyco products allow you to communicate with other users with text, pictures, and live video and audio. In order to do this, it accesses your camera, microphone, and files on your device. All of these actions are clearly indicated while using the app so you know when data is being acquired from your device. Dwyco mobile apps remove meta-data associated with photos (such as location) before it is sent from your device (on a “best-effort” basis. If your device uses a non-standard photo format, it may not be possible to remove meta-data.) Dwyco apps do not acquire camera or audio information unless explicitly requested by the user of the device.

On mobile devices, Dwyco apps may request permission to read your CONTACT LIST. However, Dwyco does not read your contact list until you specifically ask the app to perform a contact list query. The query matches the email addresses in your contact list against our existing email database. Dwyco securely sends the list of email addresses to our servers, completes the query, and returns the results securely to the app. Our servers then discard the contact list. Dwyco DOES NOT store your contact list. We do not use the email addresses for any purpose other than performing the aforementioned query.

Dwyco does not permanently store your communications, however messages may be temporarily stored on our servers if the recipient is not online. Messages that are fetched are deleted in a timely manner. We only store unfetched messages for a finite period of time before deleting them (usually much less than a year.) Public chats and real-time video/audio communications may be relayed through our servers (for "server assisted calls"), but are not stored.

If you enter an email address (and you are not required to enter one), that email address is used ONLY for purposes of enhancing the usability of Dwyco services for you. If you opt-in to our newsletter, we will send you periodic information about Dwyco products (we've only done 3 mailings in 20 years, just to give you an idea of how often we do this.) Dwyco NEVER makes its mailing list available to third parties, for any reason.

If you do not wish to receive these emails, unsubscribe instructions are provided at the bottom of the email.

If you purchase a Dwyco service, a third-party order processing company may collect personally identifiable information to process the order. Dwyco and the order processing company may send emails to you regarding the order (to deliver subscription keys, for example.) Dwyco chooses to do business with order processing companies we believe are responsible and diligent about safeguarding your information. However, Dwyco is not responsible for third-party privacy and data usage practices. You should read the order processing companies' privacy policy carefully.

Like most Web site servers the Site uses log files. This includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information. In addition, Dwyco may use Google Analytics as a method of tracking site statistics and user behavior on the Site.

You may decide to send Dwyco personally identifying information in an e-mail message which might contain information or inquiries about Dwyco’s products or services. Dwyco will use this information to identify you as a Dwyco member and to respond to the electronic mail. Dwyco will only use the information obtained to resolve the issue identified in the e-mail. Dwyco never sells e-mail addresses. You may change or request deletion of your personal information by contacting cdchelp@dwyco.com. Dwyco Only Shares Personal Information If

  • Dwyco has your consent;

  • Dwyco determines that it is required to do so by law; such as in response to a court order or subpoena;

  • Dwyco finds that you are in breach of its terms and conditions or any of its policies or usage guidelines for specific products or services;

  • it is necessary in Dwyco’s opinion to do so to prevent, investigate, detect or prosecute criminal offenses or attacks on the technical integrity of the Site or Dwyco’s network;

  • it is necessary in Dwyco’s opinion to do so to protect the rights, property, or safety of Dwyco or its employees, the users of its website(s), or the public; or

  • it is necessary to fulfill your product or service order.

Information about you and your use of the Site may be aggregated with other information collected on the Site in ways that do not personally identify you. This type of aggregated or statistical information may be used internally at Dwyco.

Does Dwyco offer opt-out or opt-in services?

Dwyco services are “opt-in”. In other words, you must specifically request a service in order to start using it. If you opt-in for a service, you can always opt-out later. Use of Dwyco services is controlled by in-app options. Dwyco will not provide or share any mailing lists or other information about you to another company or service for promotional purposes. Any service related emails (to confirm a purchase, etc.) generally do not offer an option to unsubscribe as they are necessary to provide the service you requested.

Privacy Policy changes

If Dwyco makes changes to any terms or conditions of this Privacy Policy, these changes will be posted on the Site in a timely manner. If Dwyco decides to change this Privacy Policy, it will post those changes on this Privacy Policy and other places Dwyco deems appropriate, which may include the Site, for a period of time Dwyco deems appropriate, so that you are aware of what information Dwyco collects, how Dwyco uses it, and under what circumstances, if any, Dwyco discloses it. Dwyco reserves the right to modify this Privacy Policy at any time, so please review it from time to time. In case of a business transaction in which a portion or all of Dwyco’s business is acquired, Dwyco will notify you as described above in this paragraph.

While Dwyco continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and Dwyco cannot ensure or warrant the security of any information you transmit to Dwyco. Transmitting personal information is done at your own risk.
